Marijuana Charges

It is not uncommon for an individual to be charged with possessing marijuana. As referenced on the table on our Drug Possession page, marijuana is considered a Schedule VI controlled substance. Simple possession carries less severe consequences than Schedule I & II substances like heroin or cocaine. Penalties for marijuana possession depend heavily on three factors:

  • Prior history with drug charges
  • Weight or amount of marijuana
  • Intent - personal use or sell or deliver

Possession of less than ½ ounce of marijuana is considered a Class III misdemeanor and can carry up to 30 days in jail, however probation may be required in lieu of a jail sentence.

Possessing more than ½ ounce but less than 1½ ounces is considered a Class I misdemeanor and can carry a maximum jail term of 120 days. More than 1½ ounces is considered a felony in North Carolina and carries a stiffer jail sentence.

Intent to Sell and Deliver

If you are caught possessing marijuana in a fashion that shows "intent" to sell and deliver, you will be charged with a felony and face a longer jail sentence. Having drugs in individual "baggies", possessing scales or weighing devices, and carrying large sums of money are key indicators of "intent".
