DUI/DWI :: Drunk Driving

Our state has some of the toughest drunk driving laws in the nation. These laws are designed to deter would-be drivers from driving while impaired. A drunk driving conviction can cause you to lose or have suspended driving privileges, cause your insurance premiums to increase up to 400%, and possibly require time behind bars. If charged with DUI/DWI, you will need to consult an attorney.

Across the nation, operating any motor vehicle or watercraft and having a blood alcohol content (BAC) of 0.08 or above is considered illegal. Commerical driving limits are much stiffer (BAC of 0.04 or higher). Multiple violations of this type are frowned upon by the judicial system, and may lead to an extended jail or prison sentence.

First Offense

  • Jail time from 24 hours to 2 years
  • Face fines from $200 to $4000
  • License suspended from 6 to 12 months
  • Remains on driving record for 7 years
  • DUI : Safe Driving Class
  • May receive limited driving privileges at descretion of the court
  • May receive community service

Level of consequences generally based on several factors:

  • Having minors under the age of 16 in the vehicle
  • Previously suspended or revoked license
  • Breathalyzer reading
  • Under age 21

Second Offense

North Carolina is less tolerant of multiple offenders, especially is the offenses come within a 3 year time span. Second offense can lead to a two year suspension of license and mandatory use of a ignition interlock device.

Commercial Driver with DUI/DWI

Driving a commercial vehicle with a blood alcohol content of 0.04 or above is illegal. Drivers face a 1 year revocation of their commercial driving privileges, and a two year mark on their commercial driving record.
