Domestic Violence

In North Carolina domestic violence charges are serious. Courts are not sympathetic toward individuals charged with domestic violence. Just recently, North Carolina attorney general, Roy Cooper, announced that an alarming 131 victims died in North Carolina as a result of domestic violence in 2008.

According to statute, domestic violence is defined as:

  • Attempting to cause bodily injury, or intentionally causing bodily injury;

OR

  • Placing the aggrieved party, or a member of the aggrieved party’s family or household, in fear of imminent bodily injury or continued harassment that rises to the level as to inflict substantial emotional distress;

OR

  • Committing the criminal acts of first and second rape, and first and second degree sexual offense.

This includes communicating threats of violence or harm. Specific crimes that fall within the umbrella of domestic violence include: child abuse/neglect, spousal abuse, assault on a female, harassing phone calls, and more. If you have been charged with domestic violence, or have been found in violation of a domestic violence protective order (50-B Restraining Order), you may be jailed without bond until a judge hears your case. Upon release, you may have your driving privileges limited, along with limited or no interaction with protected family members, including your children.
