Assault Charges

Assault charges often stem from avoidable situations that rise to something more serious - fights, arguments, etc. Some common misconceptions are that physical contact is required to be charged with an assault, but this is not the case when it comes to verbal assaults.

Assaults are usually a Class 1 misdemeanor in North Carolina and could carry a sentence of probation or up to one year in prison depending on prior criminal history. More serious assaults, like assault with a deadly weapon with/out intent to kill or inflict serious bodily injury, may result in sentences of more than one year depending on circumstances and prior criminal history.
